The Small Sicilian Studio (formerly Hoopla & Hype)

Important Notice — Please Read Carefully

These Terms & Conditions form a legal agreement between you (“the Client”) and Gemma Oakley, trading as The Small Sicilian Studio. By completing a purchase, submitting an application or checking “I agree to the Terms & Conditions”, you confirm that you have read, understood and agree to these terms.

All artwork, patterns, motifs, illustrations and design assets are original works protected by copyright. Usage is only permitted under the specific licence purchased and in full compliance with the terms below.

If you do not agree to these Terms & Conditions, you must not download, use, reproduce or adapt any designs from The Small Sicilian Studio.

1. DEFINITIONS

  • “Client / Licensee” — the person or business purchasing the licence.

  • “The Small Sicilian Studio” — Gemma Oakley, sole creator and owner of all artwork.

  • “Design” — any illustration, print, motif, pattern, artwork, brand asset or digital file.

  • “Intellectual Property Rights” — all copyright and associated rights owned exclusively by The Small Sicilian Studio.

2. PARTIES TO THE AGREEMENT

2.1 This Licence Agreement is between:
(a) The Licensee (the individual or business completing the purchase), and
(b) The Small Sicilian Studio (Gemma Oakley).

3. LICENCE TYPES & PERMITTED USE

Different design assets may fall under different licence categories. The licence purchased at checkout determines how the design may be used.

3.1 Non-Exclusive Pattern Use Licence

  • The design may be used by multiple brands.

  • Usage is allowed within the selected product category.

  • Licence duration: 2 years.

  • You may request renewal upon expiry.

3.2 Exclusive Pattern Use Licence

  • The design is exclusive to your brand within the chosen category for 2 years.

  • Exclusivity does not extend beyond the purchased category unless otherwise agreed.

  • Renewal is available upon request.

3.3 Limited Use Licence for Motifs, Clipart & Brand Assets

This licence permits use of design assets within your brand’s marketing and physical products, including:

  • Social media

  • Website graphics

  • Packaging

  • Email marketing

  • Digital planners / icons / stickers

  • Stationery, cards, wall art, accessories

  • Up to 100 units of physical product for resale

You may NOT:

  • Use the designs for full brand identity/branding without written permission

  • Resell, lease, lend, share or gift the files

  • Give any files to third parties (e.g., designers, manufacturers) without permission

  • Edit or modify the artwork in a way that alters the original creator’s work

  • Claim the artwork as your own

  • Upload the artwork to POD sites (e.g., Redbubble, Society6)

3.4 No Sublicensing

You may not sublicense, redistribute or allow others to use the designs under any circumstances.

4. INTELLECTUAL PROPERTY RIGHTS

4.1 All rights, ownership and copyrights to the Designs remain exclusively with The Small Sicilian Studio.
4.2 Purchasing a licence grants usage rights, not ownership.
4.3 Designs, website content and digital files are protected by UK and international copyright law.

5. PRICING, PAYMENT & DELIVERY

5.1 All prices are in GBP.
5.2 VAT is included unless otherwise stated.
5.3 Files are delivered digitally via download or email within 48 hours of purchase or licence approval.
5.4 Additional bespoke work is charged at £80 per hour.

6. TERMINATION & CANCELLATION

6.1 The Small Sicilian Studio reserves the right to terminate the licence if the Client breaches any terms.
6.2 Digital goods cannot be refunded, exchanged or cancelled once emailed or downloaded.
6.3 If a contract is required for a pattern licence, files will not be released until the contract is signed. If you choose not to sign, you will receive a refund.

7. MODIFICATIONS TO THESE TERMS

The Small Sicilian Studio may update these Terms & Conditions from time to time.
If you have purchased a licence and changes may affect your usage, you will be notified by email and given the opportunity to agree or decline the updated terms.

8. LIMITATION OF LIABILITY

8.1 You are responsible for confirming that the Design suits your intended purpose.
8.2 The Small Sicilian Studio is not liable for colour/output variations in printing or manufacturing.
8.3 Colours may differ between digital screens and printed results.
8.4 The studio cannot guarantee outcomes controlled by third parties (printers, manufacturers, suppliers).

9. CREDITING THE SMALL SICILIAN STUDIO

For self-initiated projects, the Client grants permission for designs and final outcomes to be showcased on:

  • The Small Sicilian Studio website

  • Instagram

  • Portfolio pages

  • Printed or digital promotional material

If a project is under NDA, please notify the Studio before work begins.
